Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mwl Industries FZE, trading as The Flat Set ("Company", "we", "our" or "us"). By accessing or using our website, products or services, you agree to be bound by these Terms.

If you do not agree to all terms and conditions, you must not access or use our services. We reserve the right to refuse service to anyone for any reason at any time.

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our services.

When creating an account, you agree to provide accurate, current and complete information, keep it up to date, keep your password secure and confidential, accept responsibility for all activities under your account, and notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts at our sole discretion without prior notice.

Product prices are in US dollars and do not include delivery. Your cart shows the full total, including freight and estimated import charges for your address, before you pay.

All product descriptions, images and specifications are provided for informational purposes. Colors may vary due to monitor settings and photography, and dimensions are approximate and may have manufacturing tolerances. We reserve the right to modify product specifications and prices without prior notice, and to correct pricing errors even after order placement. Product availability is not guaranteed until order confirmation.

Your order is confirmed once payment succeeds and we send a confirmation email. Every piece is made to order after confirmation.

By placing an order, you represent that you are authorized to use the payment method provided, that all billing and shipping information is accurate, and that you agree to pay all charges incurred.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, suspected fraud, or order limits. We may also require additional verification before processing orders.

Delivery times are estimates. Our Shipping & Delivery policy sets out current times and what happens if an order is late.

Returns, refunds and damaged parts are covered by our Returns & Refunds policy.

All content on our website, including but not limited to text, graphics, logos, images, product designs, software, and compilations thereof, is the exclusive property of The Flat Set or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce or distribute any content without written permission; modify, create derivative works from, or reverse engineer our products or services; use our trademarks, logos or branding without authorization; scrape, data mine or use automated systems to access our content; or reproduce our product designs for commercial purposes.

You agree not to violate any applicable laws or regulations, infringe upon the rights of others, submit false, misleading or fraudulent information, interfere with the proper functioning of our services, attempt to gain unauthorized access to our systems, transmit viruses, malware or other harmful code, or engage in any activity that could damage our reputation.

EXCEPT AS EXPRESSLY SET OUT IN OUR RETURNS & REFUNDS POLICY, OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MWL INDUSTRIES FZE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND AFFILIATES SHALL NOT BE LIABLE FOR: ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES; PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO YOUR USE OF OUR PRODUCTS; ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; OR ANY INTERRUPTION OR CESSATION OF SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS LESS.

Nothing in this section limits the refunds or replacement parts promised in our Returns & Refunds policy.

You agree to indemnify, defend and hold harmless Mwl Industries FZE and its officers, directors, employees, agents and affiliates from any claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising out of your use of our services, your violation of these Terms, or your infringement of any rights of third parties.

Binding arbitration: any dispute, controversy or claim arising out of or relating to these Terms or our services shall be resolved through binding arbitration administered by a recognized arbitration institution, rather than in court, under the rules of that institution.

Class action waiver: you agree to resolve disputes on an individual basis only, and waive any right to participate in a class action lawsuit or class-wide arbitration.

Governing law: these Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles. Any litigation is subject to the exclusive jurisdiction of the courts of Hong Kong.

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Changes become effective immediately upon posting. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
